Practical Workshop 5: Mediation (for mediators, attorneys, advocates, and expert witnesses)


This workshop is one of a series of  10 practical workshops designed and presented by the Faculty of SAMLA.  The Workshops have been accredited by UCT and CPD points are awarded for each workshop.

SAMLA recognises alternative dispute resolution and to that end has interrogated the use of ADRs including mediation in medico-legal matters. This workshop presents an overview of "medical mediation" with the understanding that mediation in medico-legal matters is unlike mediation in other matters in many respects.

The lectures include: 

  • an introduction to medical mediation;
  • a medical mediation infomercial;
  • premediation meetings;
  • the role of medical mediators; the role of legal representatives;
  • the role of expert witnesses;
  • the KZN mediation group;
  • the art of managing conflict in mediation;
  • a golden thread lecture on the ethics of mediation and litigation; a mock mediation in two parts involving a cerebral palsy judgement;
  •  the role of medical mediation in judicial case management — rule 41A.
