Introduction to Foundations of Medico-legal Practice
Because medico-legal practice forms the core of this certificate course, this module provides a brief glimpse into the meaning of ‘medico-legal’ its origin and development and how the term fits into the field of practice that developed. Medico-legal practice is today a general term used in South Africa to describe the field where medical, or healthcare professional experts work with legal practitioners, attorneys and advocates to further the interests of justice.

Introduction to Medical Law
The purpose of this lecture is to teach the most important aspects of medical law. Medical law has as its foundation the relationship between the healthcare practitioner/hospital/or clinic and the patient. From this relationship, the parties inherit rights and duties or responsibilities towards each other. These duties towards the patients, if ignored, may lead to civil and criminal liability. This lecture involves what must be shown by a plaintiff to succeed with a civil claim. It also includes what defenses are available to the defendant when defending the action. This lecture will also identify what the state must prove to sustain criminal liability where a healthcare practitioner is convicted of criminal conduct.

Interaction between Medical Law and Ethics
The scope of ethics will consist of a brief introduction to the concept ‘ethics. It will focus on the origin of the term, what the term signifies and how ethics are applied in the modern milieu, especially in the healthcare environment. The practical application of ethics includes the relationship of mutual trust between patient and practitioner, the meaning of professionalism and the adherence to professional and ethical principles and practices. These include cardiopulmonary resuscitations (CPR) and ‘Do Not Resuscitate Orders,’ the legitimacy of Living Wills and Euthanasia practices.

Alternative Dispute Resolution vs Litigation
The purpose of this module is to give the course goers, especially those to medico-legal practice an insight into both litigation and alternative dispute resolution, with an emphasis on mediation. The lecture includes the advantages of both litigation and mediation and when best these processes should and could be used.

Procedural Issues
This module is profession specific. What this course aims to do is to introduce the course goers to medico-legal practice, in which expert practitioners and lawyers play a critical role. Besides introducing the course goers to the different types of experts, this course will also deal with the nature and scope of the work they do. This module will introduce the course goers to inter alia the need for expert testimony in medical malpractice litigation. It also aims to ensure that those who attend the course will have a greater understanding of the purpose and role of expert witnesses in drafting medico-legal reports, as well as expert minutes.

Court Procedure and Conduct
This module takes the course goers through the different phases of the trial, including the evidence on the standard of care and causality applicable to the healthcare practitioners whose conduct are being measured. In addition, the module reveals the role of the expert witness, the legal team, attorney and advocate and the role and function of the Judge during the trial stage.

Mediation
This module offers those lawyers, accredited mediators, healthcare providers and other course goers the scope to improve their understanding of applying the mediation process in RAF matters as well as medical malpractice cases. A short mock mediation will be held, so that course goers acquire an idea of how mediation works in practice.
