Workshop 6: Pre-trial Procedures - Case Management
This workshop is one of a series of 10 practical workshops designed and presented by the Faculty of SAMLA. The Workshops have been accredited by UCT and CPD points are awarded for each workshop.
This workshop addresses pre-trial procedures — case management.
The management of cases has changed significantly in South Africa and this series of lectures proposes a model of practice for pre-trial procedures. The model is presented and interrogated. The lectures include:
- the impact of case management on the judicial system in South Africa;
- practitioner controlled case flow management;
- preliminary case assessment phase;
- the investigative phase;
- gathering supportive facts to determine the merits and quantum;
- explaining the test of medical certainty and the legal test based on the balance of probability;
- the selection phase in two parts;
- introducing case management of civil trial cases;
- options open to defendant after being sued;
- pre-trial procedures case management;
- pre-trial preparations; pre-trial preparations — final settlement;
- factors influencing the settlement talks;
- how expert witnesses may promote the case management process by arranging the joint meeting of the experts and drafting joint minutes of the meeting;
- unpacking the role of the important players including expert witnesses in complying with the practice directives to promote case management;
- the role of the industrial psychologist in providing an ultimately meaningful, ethical and rational outcome;
- developing a case management plan.
